Please read this notice before using the app
This notice forms part of the Terms of Service. It explains who owns the third-party materials shown in this app (the "Third-Party Materials"), the ways we use them, and the dedicated channel for rights holders to report infringement.
This notice does not apply to User Content you upload, publish or input. Ownership and liability for User Content are governed by Section 8 of the Terms of Service.
We want to be plain about this: copyright and trademark rights in Third-Party Materials always belong to their respective owners. We claim no ownership over them. We use them either under licence or within the scope of lawful nominative use, and we accept and act on notices from rights holders.
1Scope
1.1 This notice applies to preset materials displayed, distributed or made downloadable in this app, including without limitation graphics, icons, fonts, template artwork, template layouts, sample content and the materials list itself.
1.2 "Third-Party Materials" means materials whose intellectual property rights belong to third parties and which we present under licence or in a manner permitted by law as nominative use.
1.3 This notice does not apply to User Content. Ownership and liability for the cards, images, text, prompts and generated results you upload, publish, store or input are governed by Section 8 of the Terms of Service.
1.4 If this notice conflicts with the Terms of Service, this notice prevails with respect to ownership, use limits and the complaint process for Third-Party Materials; all other matters are governed by the Terms of Service.
2Our own intellectual property
2.1 The software code, interface design, original illustrations and original graphics of this app, together with the "Kiraify" and "Qixiao" marks and related identifiers, are owned by Hangzhou Qixiao Technology Co., Ltd. or the relevant rights holder and are protected by the Copyright Law, Trademark Law and Patent Law of the People's Republic of China.
2.2 Without our prior written permission, you may not copy, modify, distribute, publish, reprint, translate, sell, sublicense or commercially exploit any of the foregoing.
2.3 This Section does not apply to the Third-Party Materials listed in Section 4, whose rights remain with their respective owners.
3Ownership principles for Third-Party Materials
3.1 This app contains materials whose intellectual property rights belong to third parties. The copyright, trademark and other rights in such materials remain with their respective owners. We assert no ownership over them and acquire no rights merely by displaying them in the app.
3.2 We use Third-Party Materials either under licence from the rights holder or on the basis of lawful nominative use — that is, solely to identify a real connection that you yourself have chosen to enter.
3.3 The list of Third-Party Materials is set out in Section 4. It changes as the product evolves; we will update this notice and the "Materials list last verified" date accordingly.
If you own the relevant rights and believe our use exceeds the licence or the nominative use scope, please contact us directly at copyright@kiraify.cn — no account registration or login is required. See Section 7 for how we handle notices.

4.4 Other than the above, this app contains no copies of third-party protected works. If you believe third-party material appears in the app that is not listed here, please notify us under Section 7 and we will verify it, register it or remove it.
4.5 For templates made available in this app, we provide the layout, colour scheme and graphic composition. Where such a template contains Third-Party Materials, Sections 5 and 6 govern their ownership and use.
5Limits on use of Third-Party Materials
5.1 Purpose limitation: we display third-party marks solely to identify the real connection you have chosen to enter — that is, to indicate which game or which social platform your card relates to. Third-party marks are not used as decoration.
5.2 No implication of a special relationship: we do not use third-party marks in a way that suggests authorisation, agency, partnership, sponsorship or official endorsement; we do not place them alongside the "Kiraify" mark or in any position likely to cause confusion; and we do not use them to endorse you or any third party.
5.3 No alteration of the marks: we do not distort, crop or splice third-party marks, and do not change their proportions, colours or constituent elements.
5.4 Your own limits: when you use third-party materials in the app or on your card, you must stay within the nominative use scope above; you must not use third-party marks for goods or services identical or similar to those of the rights holder; you must not use them in any way likely to cause confusion in the market; and you must not imply any authorisation, agency or partnership with the rights holder.
5.5 The same limits apply when you export your card as an image or QR code, or share it to third-party platforms.
6Your licence and liability for preset materials
6.1 When you apply a preset template from the platform, we licence you to use the template layout design (layout, colours and original graphic composition) for personal or commercial purposes. That licence does not automatically extend to the Third-Party Materials embedded in the template.
6.2 A template containing Third-Party Materials may be displayed together with your card only where that material's use stays within the nominative use scope in Section 5. Beyond that scope, you should remove the material yourself or obtain the rights holder's authorisation first.
6.3 You bear responsibility for any dispute or claim arising from your use of Third-Party Materials beyond the permitted scope, and shall indemnify us against loss caused thereby. We make reasonable efforts to label the ownership of materials within templates, but this does not relieve you of the duty to verify before use.
6.4 In response to a rights-holder notice, a takedown request or legal requirements, we may adjust, replace or remove any preset material at any time without further notice. Such changes do not affect content you have saved, exported or otherwise retained, and do not relieve you of liability for content you have already published.
7Rights-holder notice and takedown
7.1 We accept and take infringement notices from rights holders seriously. If you are the lawful owner of rights in a work, mark, likeness, name, voice or other right (or an duly authorised agent), and believe content displayed in this app infringes your rights, please notify us:
7.2 You do not need to register or log in to submit a notice.
7.2.1 Required materials
Please provide as much of the following as possible. If anything is missing, we will acknowledge your notice and tell you what we still need:
- Proof of your identity and valid contact details (name or entity, entity type, email or phone);
- Proof of rights — for works, evidence of ownership; for trademarks, the registration certificate and the designated goods or services;
- A precise location of the disputed content: page URL, card ID, template identifier, material filename, or a screenshot;
- The type of right claimed and an explanation of how the use infringes it;
- The remedy you seek (stop display / delete the content / disconnect the link / take down the template);
- A statement from you that the materials provided are true and accurate and that you are the rights holder or are duly authorised.
7.2.2 Process and timelines
- Within 24 hours of receiving a complete notice, we will hide the disputed content pending review (hiding does not imply a finding of infringement);
- We will complete the rights review and reach a final decision within 5 business days;
- Once processed, we will acknowledge the outcome to the complainant in writing and simultaneously notify the publisher of the affected content.
7.2.3 Remedies
Stop display → delete the content and related materials → disconnect sharing links and QR codes → restrict or terminate the relevant account → report to the competent authorities.
7.2.4 Appeal and review
If you consider our decision incorrect, you may appeal within 10 business days of receiving the decision, using the same email address, with supporting material. We will complete the review and inform you of the outcome within 5 business days of receiving the appeal. The content remains hidden during the review.
7.2.5 Erroneous notices
If your notice does not hold up on review, we will impose no restriction on you as a result. Please also note that repeatedly submitting manifestly unfounded notices may be treated as abuse of the notice process, in which case we may reduce the frequency at which we accept notices or take other necessary measures.
8Generated content and similarity
8.1 Output from the generative AI service may be similar to existing works. We do not guarantee that generated output is fully original, nor that it will not be substantially similar to works published by others.
8.2 When using the generative AI service, you must not prompt, request or steer it to produce content containing specific works, characters, trademarks, the names or likenesses of others, nor use the output to impersonate an officially authorised product. See Section 6 of the Terms of Service.
8.3 Where generated content involves third-party intellectual property (including images, fonts, logos and brand names), you must determine whether authorisation is required and bear the corresponding responsibility. See Section 6.3.3 of the Terms of Service and Section 7.4 of the Privacy Policy.
9Material registration and update process
9.1 We operate a source registration process for preset materials: before any new material ships, its rights holder, source address and basis of use (licence evidence, or the reasoning supporting nominative use) must be registered and reviewed by our legal team. Registration data is retained at build time for traceability and evidentiary purposes.
9.2 We periodically verify that the materials list matches what is actually displayed. The result is reflected in the "Materials list last verified" date at the top of this notice.
9.3 We maintain a closed loop of "registration → notice handling → takedown → review": once a rights-holder notice is verified, the corresponding material is removed from both the app and the content distribution network, and the list is updated in the next version of this notice.
